Right of Withdrawal for Consumers

The right of withdrawal applies exclusively to consumers (any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity).

If you wish to report defective goods, please send us a few photos of the received shipment and include your order number. We will then work with you to find a solution. You can easily contact us via the contact form.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

on which you or a third party designated by you, who is not the carrier, took possession of the goods, provided you ordered one or more goods as part of a single order and these are delivered together;
on which you or a third party designated by you, who is not the carrier, took possession of the last item, provided you ordered several goods as part of a single order and these are delivered separately;
on which you or a third party designated by you, who is not the carrier, took possession of the last partial shipment or the last item, provided you ordered goods that are delivered in several partial shipments or pieces;

To exercise your right of withdrawal, you must inform us (Fonteino OÜ, c/o WO-WE GmbH & Co. KG, Lahnweg 5, 35232 Dautphetal, Germany, Phone: +49 6461 9265411, Email: shop@fonteino.com) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post or an email). You may use the attached sample withdrawal form, although this is not mandatory.

You may also complete and submit the sample withdrawal form or another clear declaration electronically via our website (https://www.fonteino.com/pages/widerruf-formular). If you make use of this option, we will immediately send you confirmation of receipt of such withdrawal (e.g., by email).

You may also exercise your right of withdrawal online via the appropriately designated button ("Withdraw Contract" or similar wording) on our website (www.fonteino.com (https://www.fonteino.com)). If you use this online function, we will immediately provide you with confirmation of receipt on a durable medium (e.g., by email), including the content of the withdrawal declaration as well as the date and time it was received.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.

We may withhold reimbursement for goods that can be returned by parcel until we have received the returned goods or until you have provided proof that you have returned the goods, whichever occurs first.

We will collect goods that cannot be returned by parcel.

You must send back or hand over the goods that can be returned by parcel without undue delay and in any event no later than 14 days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.

You bear the direct costs of returning goods that can be returned by parcel as well as the direct costs of returning goods that cannot be returned by parcel. The costs for returning goods that cannot be returned by parcel are estimated at a maximum of approximately EUR 250.

You are only liable for any diminished value of the goods if this diminished value results from handling the goods in a way that was not necessary to examine their nature, characteristics, and functioning.

Exclusions and Early Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer;
for the supply of goods that are liable to deteriorate rapidly or whose expiration date would quickly be exceeded;
for the supply of alcoholic beverages whose price was agreed upon at the time the contract was concluded but which can only be delivered at least 30 days after the conclusion of the contract and whose current value depends on market fluctuations over which the trader has no control;
for the supply of newspapers, periodicals, or magazines, except for subscription contracts.

The right of withdrawal expires prematurely for contracts:

for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
for the supply of goods which, after delivery, have been inseparably mixed with other goods due to their nature;
for the supply of sealed audio or video recordings or sealed computer software if the seal has been removed after delivery.
